Terms of Service

These Terms of Service ("Terms") form a binding agreement between you ("you", "User") and Mythral, operator of the website and the software known as "Mythral" (collectively, the "Service"). By creating an account, purchasing a license, or using any part of the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
1.1. You must be at least 18 years old, or the age of legal majority in your jurisdiction, whichever is higher, to purchase or use the Service.
1.2. By using the Service you represent that (a) you meet the age requirement above, (b) you have the legal capacity to enter into this agreement, and (c) you are not barred from using the Service under the laws of your jurisdiction.
1.3. You are solely responsible for ensuring that your use of the Service complies with all laws and third-party agreements applicable to you.
2. The license you receive
2.1. When you purchase a subscription or one-time license, you receive a personal, non-exclusive, non-transferable, revocable license to use the Mythral software for the duration and on the terms you selected at checkout.
2.2. You do not receive ownership of the software, its source code, or any intellectual property. All rights not expressly granted are reserved.
2.3. Your license is bound to a single end user. The software may also be bound to specific hardware ("HWID binding") to enforce this.
2.4. You may not resell, sublicense, lease, lend, distribute, or share your license, account, or software with any third party. Attempts to do so will result in immediate, permanent termination of your license without refund.
2.5. You may not reverse engineer, decompile, disassemble, or attempt to extract the source code of the software, except and only to the extent that applicable law expressly permits despite this restriction.
3. Acceptable use
3.1. You are responsible for the manner in which you use the Service and any consequences that arise from that use.
3.2. You agree not to use the Service (a) to harass, harm, or defraud any person; (b) to violate any law; (c) to attempt to breach, disrupt, or probe the Service's security, or that of any connected system; or (d) in any manner that creates liability for us.
3.3. You acknowledge that the software may interact with third-party applications and online services that have their own terms of use. You are responsible for complying with those terms, and you accept that using the software may cause those third parties to restrict or terminate your separate accounts or access. We are not responsible for any such action by third parties.
4. Payment, subscriptions, and refunds
4.1. All prices are listed in USD and are exclusive of applicable taxes unless stated otherwise. You are responsible for any taxes that apply in your jurisdiction.
4.2. Payment is collected by our payment processor(s) at the time of purchase. By completing a purchase you authorize the processor to charge the payment method you provide.
4.3. Subscriptions renew automatically at the end of each billing period at the then-current price unless cancelled before the renewal date. You can cancel at any time from your dashboard; cancellation stops future renewals and does not refund the current period.
4.4. Refund policy. Because Mythral is a digital product delivered immediately on purchase and contains functionality that cannot be "returned" once accessed, all sales are final and no refunds are issued after a license has been delivered, except where refund is required by applicable law. If you believe a charge is incorrect or the software has never worked for you, contact support within 7 days of purchase and we will investigate in good faith.
4.5. If you initiate a chargeback or payment dispute with your bank or card issuer without first contacting us to attempt resolution, we may terminate your license and account immediately, and recover any costs we incur from the dispute.
5. Account security
5.1. You are responsible for keeping your login credentials, license keys, and any connected email account secure.
5.2. You must notify us via our Discord as soon as you become aware of any unauthorized use of your account or license.
5.3. We are not liable for losses arising from your failure to secure your account.
6. Changes to the Service
6.1. The Service is offered on an evolving basis. We may modify, add, or remove features, change system requirements, or pause functionality without prior notice when necessary for security, legal, or technical reasons.
6.2. If a change materially and adversely affects a subscription you have paid for, we will attempt to notify you, and, at our discretion, offer a partial refund or credit.
7. Suspension and termination
7.1. We may suspend or terminate your access to the Service, with or without notice, if (a) you breach these Terms, (b) we reasonably suspect fraud, account sharing, or abuse, (c) we are required to do so by law, or (d) continued provision of the Service to you creates a material risk to us or to other users.
7.2. On termination, the license granted to you immediately ceases and you must stop using the Service and delete any local copies of the software.
7.3. Sections 2.5, 4, 8, 9, 10, 11, 12, and 14 survive termination.
8. Disclaimer of warranties
8.1. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
8.2. We do not warrant that the Service will be uninterrupted, error-free, secure, or that it will continue to function following updates to third-party software or systems.
8.3. Some jurisdictions do not allow limitations on implied warranties; in those jurisdictions the limitations above apply only to the extent permitted.
9. Limitation of liability
9.1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, LOSS OF GOODWILL, OR LOSS OF ACCESS TO THIRD-PARTY SERVICES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
9.2. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
9.3. Nothing in these Terms limits liability that cannot be limited by law, including liability for death, personal injury caused by negligence, or fraud.
10. Indemnification
10.1. You agree to defend, indemnify, and hold us harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising out of (a) your use or misuse of the Service, (b) your breach of these Terms, or (c) your violation of any third-party right, including any third-party terms of service.
11. Intellectual property and takedown
11.1. Mythral, the Mythral mark, the site and all software are our intellectual property or that of our licensors.
11.2. If you believe content on our site infringes your intellectual property rights, contact us via Discord with a signed notice containing: your identity, the work claimed to be infringed, the material on the site, and a statement of good-faith belief that the use is unauthorized. We will respond in accordance with applicable law.
12. Governing law and dispute resolution
12.1. These Terms are governed by the laws of Hungary, without regard to conflict-of-laws principles.
12.2. Any dispute arising under these Terms shall be resolved exclusively by the competent courts of Budapest, Hungary, subject to any mandatory rights you may have as a consumer to bring proceedings in your country of residence.
12.3. Before filing a lawsuit, you agree to first contact us and attempt in good faith to resolve the dispute for at least thirty (30) days.
13. Communications
13.1. You agree that we may send you operational messages related to your account, license, purchases, and security events. These are not marketing messages and cannot be opted out of while you have an active account.
14. Miscellaneous
14.1. Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service.
14.2. Severability. If any clause is found unenforceable, the remaining clauses stay in effect and the unenforceable clause is modified only to the minimum extent necessary.
14.3. No waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
14.4. Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
14.5. Updates to these Terms. We may update these Terms from time to time. The "Last updated" date reflects the current version. Material changes will be announced at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
